Al-Nashiri’s application against Poland communicated to the Polish Government

The European Court of Human Rights in Strasbourg communicated to the Polish authorities the application brought in the case of al-Nashiri vs. Poland. The ECtHR obliged the Polish Government to disclose a series of information concerning the case of 5 September 2012.

It requested Poland, among other things, to respond to the question whether al-Nashiri was detained in a CIA secret detention centre in Poland and whether Poland has a document governing the establishment or operation of such a secret prison. In June, the Polish media informed the public on the existence of a draft understanding that allegedly had been handed out by the Polish Intelligence Agency to prosecutors. In addition, Poland was asked to furnish the materials which were the basis of a decision on awarding the status of the injured party to al-Nashiri in the domestic criminal proceedings.

Abd al-Rahim al-Nashiri was allegedly detained in Poland between 5 December 2002 and 6 June 2003. The applicant claims that in that period he was subjected to interrogations which violated his rights. The investigators purportedly used such techniques as simulating the execution by means of a power drill, holding the detained in stress positions for a long period of time and threatening to use sexual violence against his mother.
