Letter of solidarity with civil society in Hungary

On 13 February 2018, Hungarian Government sent to the Parliament a draft legislation package of three laws, commonly known as “Stop Soros”. If adopted, the new legislation would curb the Hungarian civil society’s ability to work by requiring organisations that “support immigration” to obtain a domestic security certificate and a governmental permission to perform their basic functions.

The proposed legislation also seeks to oblige NGOs to pay a 25% tax on all foreign donations whose purpose is to “support immigration”.

Non-complying NGOs would be sanctioned with exorbitant fines, insolvency or even compulsory liquidation.

These proposals of the Hungarian government impose additional restrictions on the already shrinking space for civil society in Hungary and violate the country’s international obligations related to the protection of the right to freedom of assembly, freedom of speech and freedom of movement.

We consider the new legislative proposals an expression of the intensified efforts made by Hungary’s government in order to oppose the activities of those of the civil society groups in Hungary that advance and protect human rights, provide domestic legal and social services to persons in need and publicly express their different opinions in the press and online.

As human rights defenders, we would like that all people around the world may speak their minds without the risk of attacks, threats or a prison sentence. An open debate on issues related to government policies and practices is necessary in every society and human rights defenders should not be sanctioned for expressing their opinions, which may be different from the ruling party’s line. Rather than legislating repressive rules designed to silence people speaking their minds, states should enact laws that protect human rights defenders from harm.

Human rights defenders act for the rights of persons in their communities and countries, thus protect our rights globally. Human rights advocates are often the last line of defence of the free and just society; they accept enormous personal risks and make sacrifices to do their job.

We stand united with the civil society and human rights defenders in Hungary.

These are brave men and women committed to creating a more just society. Without their courage, the world we live in would be less just and less equal.

We call on the Hungarian Parliament to reject the proposed legislation in its entirety and to enable non-governmental organisations and human rights defenders to continue their work without being forced to mount a defence against legislative attacks.
