HFHR requests Prosecutor’s Office for access to public information

The Helsinki Foundation for Human Rights lodged the request with the Appellate Prosecutor’s Office in Cracow, seeking access to public information. The Foundation asked for information concerning procedural issues related to investigation into secret CIA prisons in Poland (case no. Ap V Ds. 12/12/).

One of the Foundation’s enquiries regarded information on the motion to extend the said investigation made by the Appellate Prosecutor’s Office to the Prosecutor General. The points of particular interest to the HFHR were the legal and factual basis for filing the motion. The applicant also wanted to know whether the Appellate Prosecutor’s Office decided to grant or dismiss the motion.

Further, the Foundation inquired about another request for legal assistance submitted to relevant US authorities and a planned date for the completion of the investigation. Moreover, the HFHR moved the Prosecutor’s Office to verify whether the European Court of Human Rights received the information collected by the Office, the disclosure of which was announced by the Government in its observations of 5 September 2012, and also whether this information is classified.
